This Privacy Policy describes how AFX Logistics ("we," "us," "our") collects, uses, shares, and protects personal information when you visit our website at afx-logistics.com, request a freight quote, book a shipment, apply for credit, register as a carrier, apply for a job, create an account, or otherwise interact with our services. It applies to shippers, carriers, website visitors, and applicants. By using our services, you acknowledge the practices described in this policy.
1. Information We Collect
1.1 Information you provide directly
When you use our services, we collect information you provide, including:
- Contact and identifiers: name, company name, email address, phone number, and billing or business address.
- Shipment information: origin and destination addresses and ZIP codes, pickup and delivery dates, commodity descriptions, weights, dimensions, freight class, declared value, and accessorial requirements.
- Account information: email address, password (stored using industry-standard hashing), and profile details if you create an account.
- Business and credit-application information: if you apply for a credit account, we collect business details (such as legal business name, federal tax ID/EIN, business type, and date established), accounts-payable contacts, trade references, banking references (bank name, phone, and officer), and any authorization you provide for us to contact those references. This information is used to evaluate and administer credit.
- Carrier information: if you register as a motor carrier, we collect operating authority (USDOT/MC), insurance certificates (COI), tax forms (such as a W-9, which may include a taxpayer identification number), settlement and payment details, and signed agreements (including the date, name, version, and IP address associated with your electronic signature).
- Payment information: bank/ACH details or other payment information you provide so we can invoice you or pay you. We do not store full payment card numbers on our servers.
- Communications: the content of emails, text messages, chat and contact-form submissions, and notes from phone conversations with our team.
- Job-application information: if you apply for a role, the information in your application or resume.
1.2 Information collected automatically
When you visit our website, we and our analytics providers automatically collect:
- Device and connection information: IP address, browser type and version, operating system, device type, and screen resolution.
- Usage data: pages visited, time on page, links clicked, referring URLs, and the search terms used to find our site.
- Cookies and similar technologies: small data files and identifiers stored on your device. See Section 5.
We do not use third-party analytics or advertising trackers inside our native mobile apps; the automatic collection above primarily applies to our website.
1.3 Information from third parties
We may receive information about you from third parties, including:
- Freight market data providers used to generate live rate quotes.
- Mapping and geocoding services used to look up addresses and ZIP codes.
- Identity verification, carrier authority/insurance verification, and fraud-prevention services (including FMCSA data sources).
- Credit and trade references you authorize us to contact.
- Carriers, shippers, and other partners with whom we coordinate your shipments.
2. How We Use Your Information
We use the information we collect to:
- Provide our services: generate quotes, book and dispatch shipments, coordinate with carriers, verify carriers, process payments and settlements, and communicate about your shipments.
- Evaluate credit and manage accounts: assess creditworthiness, set terms, and administer billing and collections.
- Improve our services: understand how our website is used, develop features, analyze freight market trends, and optimize pricing.
- Communicate with you: send shipment status updates, respond to inquiries, send account notices, and (with your consent or where permitted by law) marketing communications by email, phone, or text.
- Security and fraud prevention: detect, investigate, and prevent fraud, abuse, and unauthorized access.
- Comply with legal obligations: meet recordkeeping, tax, and regulatory requirements (including those of the FMCSA), respond to lawful requests, and enforce our Terms of Service.
3. How We Share Your Information
We share personal information only as described below. We do not sell your personal information for money. See Section 8 for how certain online advertising or analytics activity may be treated as a "sale" or "share" under some state laws, and how to opt out.
3.1 Carriers
To fulfill your shipments, we share the information necessary to pick up and deliver your freight, including pickup and delivery addresses, contact names and phone numbers, commodity descriptions, and special instructions, with the motor carriers we contract to haul your loads.
3.2 Service providers
We share information with third-party service providers that help us operate, including hosting and infrastructure providers, payment and banking processors, email and SMS providers, analytics services, mapping and market-data providers, and customer-support tools. These providers process data on our behalf under contractual obligations to protect it and use it only for the services they provide to us.
3.3 Legal and regulatory disclosures
We may disclose information when required by law or valid legal process, or to protect the rights, property, or safety of AFX Logistics, our customers, our carriers, or others. This includes responding to subpoenas, court orders, and law-enforcement requests.
3.4 Business transfers
If we are involved in a merger, acquisition, financing, sale of assets, or reorganization, your information may be transferred to the successor or acquiring entity. We will notify you of any such change as required by law.
4. Data Retention
We retain personal information for as long as necessary to provide our services and for the periods required by law. This includes federal motor carrier broker recordkeeping (generally three years for brokerage transaction records under 49 C.F.R. Part 371) and tax and accounting requirements (generally up to seven years). We also retain information as needed to resolve disputes, enforce our agreements, and meet our legal obligations. When information is no longer needed, we delete or de-identify it.
5. Cookies and Tracking Technologies
We use cookies and similar technologies to operate and improve our website. They fall into these categories:
- Strictly necessary: required for the website to function (for example, session cookies that keep you logged in).
- Functional: remember your preferences (for example, quote-form draft data).
- Analytics: help us understand how visitors use our site. We use Google Analytics 4 for this purpose, and a first-party usage measurement that counts page visits. Google Analytics sets its own cookies and processes data under Google's policies; learn more and opt out via the Google Analytics Opt-out Browser Add-on.
- Advertising: where enabled, we may use advertising and conversion-measurement technologies (such as the Meta Pixel and Google Ads) and B2B website-visitor identification tools to measure campaigns and reach relevant audiences. These technologies may share online identifiers with the providers. You can opt out as described in Section 8.
Most browsers let you control cookies through their settings, and you can use browser-level opt-out signals (see Section 8). Blocking strictly necessary cookies may prevent parts of our website from working correctly.
6. Your Privacy Rights
Depending on your state or country of residence, you may have some or all of the following rights regarding your personal information:
- Know / access the personal information we hold about you and how we use and share it.
- Correct inaccurate or incomplete information.
- Delete your personal information, subject to our legal retention obligations.
- Portability: request a copy of your information in a portable format.
- Opt out of the "sale" or "sharing" of your information and of targeted advertising (see Section 8).
- Limit certain uses, and opt out of marketing communications at any time (use the unsubscribe link in our emails, reply STOP to texts, or contact us).
- Non-discrimination for exercising your rights, and the right to appeal a denied request where state law provides it.
To exercise these rights, contact us using the information in Section 12. We will verify your request (and may ask for information to confirm your identity) and respond within the time required by applicable law. You may use an authorized agent to submit a request where the law permits, subject to verification.
7. State Privacy Disclosures
Several U.S. states, including California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and others, provide comprehensive privacy rights to their residents. The rights listed in Section 6 reflect those laws. Residents of these states may exercise their rights as described above.
California residents. Under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA), you have the rights described in Section 6, including the right to know the categories of personal information we collect, the sources, the business or commercial purposes for collecting or sharing it, and the categories of third parties to whom we disclose it. These rights extend to personal information of business contacts and employees. AFX Logistics does not sell personal information for money, and you may opt out of any "sharing" for cross-context behavioral advertising as described in Section 8. We do not use or disclose sensitive personal information for purposes that require a right to limit under the CPRA.
8. Your Privacy Choices (Do Not Sell or Share)
AFX Logistics does not sell personal information for money. However, when advertising or analytics technologies are enabled (see Section 5), the use of online identifiers and cookies for cross-context behavioral advertising or measurement may be considered a "sale" or "share" of personal information, or "targeted advertising," under certain state privacy laws.
You can exercise your choices in the following ways:
- Opt-out preference signals: we honor recognized browser-based opt-out signals, such as Global Privacy Control (GPC), where required by law. When we detect a valid GPC signal, we treat it as a request to opt out of the sale or sharing of personal information for that browser or device.
- Browser and cookie controls: you can manage or block cookies in your browser settings and use the Google Analytics Opt-out Browser Add-on.
- Contact us: submit a request using the information in Section 12, and we will process your opt-out.
9. Text Messages, Calls, and Email
If you provide your phone number and consent, we may contact you by phone and text message about your quotes, shipments, and account, and, where you have agreed, for marketing. Consent to marketing texts or calls is not a condition of any purchase. Message frequency varies, and message and data rates may apply. You can opt out of texts at any time by replying STOP, and opt out of marketing emails using the unsubscribe link. We may still send transactional messages needed to service your shipments. See our Terms of Service for our SMS terms.
10. Data Security
We implement reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, alteration, disclosure, or destruction, including encrypted data transmission (HTTPS), encrypted password storage, access controls, and security monitoring. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. We will notify you of a data breach affecting your personal information where required by applicable law.
11. Children's Privacy; International Users
Our services are intended for businesses and are not directed to children under 16. We do not knowingly collect personal information from children under 16; if we learn we have, we will delete it. AFX Logistics is based in the United States, and our services are intended for users in the United States and Canada (for cross-border freight). If you access our services from elsewhere, your information will be transferred to and processed in the United States, which may have different data-protection laws than your country of residence.
